A federal judge in Illinois dismissed Compass Group USA’s claim that Illinois’ Biometric Information Privacy Act should be considered “special legislation” that violates the state’s constitution, Reuters reports. The food and support services company argued BIPA discriminates between groups as it exempts public employers, public contractors and financial institutions. U.S. District Judge Virginia Kendall disagreed saying the exclusion of these entities is “eminently rational.” The judge did dismiss a claim involving data retention and destruction.
