The Federal Trade Commission (FTC) has responded to LabMD’s motion to dismiss the data security case against it, saying the now-defunct company is attempting to distract the court from the “voluminous evidence” the agency has against it, Law360 reports. In papers filed with the court last week, the FTC said, “Respondent’s motion is the latest in a series of attempts to avoid the court’s determination on that question and distract from respondent’s data security failures with unfounded, unsupported and untrue suggestions of complaint counsel misconduct and conspiracy.” Additionally, the FTC argues that since it has presented “overwhelming evidence” demonstrating a violation of the deception portion of Section 5, the case against LabMD should proceed.
