Following a comment period, the U.S. Federal Trade Commission has issued its final consent order with Turn, an ad-tech company that allegedly tracked consumers online and across devices "even after consumers took steps to opt out of such tracking." While Turn's privacy policy said consumers could block tracking via browser settings, the FTC alleges Turn used the so-called Verizon "super cookie" to track them anyway. As part of the consent order, Turn has agreed to stop misrepresenting the ability of consumers to opt out of tracking and to place a prominent link on its home page explaining its tracking capabilities and how to opt out of them. In two letters to commenters on the order, the FTC notes that it does not have the authority to issue a fine for this first violation, but Turn risks fines of $40,654 per violation, per day, should it engage in the same practices again.
