The Federal Communications Commission is expected to pass its new privacy rules on Oct. 27, and broadband providers could push back against them depending on how similar the revised rules are with the current FCC enforcement practices, the Morning Consult states. While a net neutrality rule allows FCC oversight for ISPs, "industry giants ... have argued that the privacy rules still might not align with the FCC’s authority to regulate privacy under the 1996 Telecommunications Act," the report states. "If broadband providers decide to sue, that argument will likely be the one that they use." Meanwhile, Multichannel News reports that chief telecom counsel of the House Energy & Commerce Committee Democrats David Goldman has said that ranking member Frank Pallone, D-N.J., advocates "harmonizing the FCC's and FTC's online privacy authority" and that the FCC should move forward with a "strong vote" on broadband privacy rules. Broadcasting & Cable additionally reports that FCC Commissioner Mignon Clyburn has indicated that the rules may have restrictions on mandatory arbitration clauses.
