The Irish Supreme Court announced it will hear Facebook’s appeal of a referral to the Court of Justice of the European Union 21 Jan., The Irish Times reports. Justice Caroline Costello determined the validity of standard contractual clauses between the U.S. and the EU should be determined by the CJEU. Facebook’s appeal is expected to last for three days. One of the issues expected to be addressed is whether Facebook has any grounds to appeal the referral. Facebook states it does, in fact, have the right and added the Supreme Court will find the EU-U.S. Privacy Shield agreement means there is no requirement for a referral to be made.
