Plaintiffs’ attorney Jay Edelson described Facebook’s $650 million class-action settlement over alleged Illinois’ Biometric Information Privacy Act violations as “a make-or-break moment for the privacy bar” that establishes “a new model” for settlements. A claims rate of 22% is anticipated, with class members each receiving $345. Edelson compared it to a $92 million settlement by TikTok over BIPA allegations, with an estimated claims rate of 1% to 2% of national users, telling IAPP Staff Writer Jennifer Bryant it “shows how much work still needs to be done to make sure that privacy settlements really benefit the class members.”
