A federal appeals court has agreed to accept hotel chain Wyndham’s petition to appeal Federal Trade Commission (FTC) vs. Wyndham Worldwide Corporation et.al to determine whether the FTC has the authority to “bring charges against companies based on their alleged failure to protect consumers' data,” reports MediaPost. The U.S. Chamber of Commerce, American Hotel & Lodging Association and National Federation of Independent Business filed a friend-of-the-court brief in support of the appeal, stating, “Whether the FTC’s enforcement authority ... extends to regulation of data security is an issue of central importance to businesses that face the prospect of being investigated by the commission.” Editor’s Note: See an analysis of this case and others in the IAPP’s FTC Privacy Casebook.
