The Supreme Court of Ireland has referred to the Court of Justice of the European Union to decide whether a man’s accounting exam is considered personal data under the Data Protection Act, Independent.ie reports. After being denied access to his test by both his school and the Data Protection Commissioner, plaintiff Peter Nowak argued in the Circuit Court and then appealed to the High Court that his handwritten test qualified as biometric, and therefore personal data, the report states. He further argued that as exam results are “considered personal,” the test and exam comments ought to be too.
