Court of Justice of the European Union Advocate General Maciej Szpunar issued an opinion on a case between the Romanian National Authority for the Supervision of the Processing of Personal Data and telecommunications provider Orange România. The DPA issued a penalty on the basis that Orange România copied customers’ identity documents and kept them without consent. Responding to a request from a Romanian regional court, Szpunar found the telecommunication company’s customers did “not give their free, specific and informed consent under the circumstances described by the referring court.”
