According to Reuters, Austria's Supreme Court referred Max Schrems' case against Facebook over explicit consent for the use of personal data to the Court of Justice of the European Union. Among the questions sent to the CJEU was whether Facebook's declaration of data processing intentions undermined the protection provided through user consent under the EU General Data Protection Regulation. The CJEU will also consider whether Facebook's data practices respect data minimization requirements under the GDPR.
