The Associated Press reports that Apple plans to tell a federal judge that Congress should decide the outcome of the San Bernardino iPhone case, not the courts, and that code is free speech under the First Amendment. One lawyer representing Apple said, “The government is really seeking to push the courts to do what they haven’t been able to persuade Congress to do.” Rep. Ted Lieu, D-Calif., has also asked the FBI to rescind its request for technical assistance from Apple, arguing, like Apple, that Congress should be the ultimate arbiter on the issue. The Department of Justice has also requested that Apple help it unlock at least nine other iPhones, bolstering fears that the California case is just the tip of the iceberg for special government access requests. Reuters, meanwhile, reports on a new poll revealing that public support may be growing for Apple in the case, and Ford Motor Company CEO Mark Fields said the company is pro-privacy and added, “We’re watching the (Apple) situation closely.”
