The U.S. Court of Appeals for the 3rd Circuit shot down an attempt by a former Coca-Cola employee to revive his data breach lawsuit, PennLive reports. Shane Enslin's information was compromised when another former employee stole company laptops containing co-workers’ personal data. Despite Enslin showing unauthorized purchases made on his accounts after the breach occurred, a U.S. Eastern District Court ruled there was no proof the transactions were made due to the breach, a decision the appeals court upheld. Judge Thomas M. Hardiman argued in the court’s opinion that Enslin does not know who accessed the accounts or how they did so, nor did Hardiman have to pay for the fraudulent charges.
