While the privacy world looks at the possibility of a world without Safe Harbor, following Advocate General (AG) Yves Bot’s opinion in the Schrems case before the European Court of Justice, there hasn’t been much discussion of whether the opinion is actually good for privacy in the EU. IAPP VP of Research and Education Omer Tene argues decidedly in the negative: “Brought to its logical conclusion, the AG’s decision proves too much.” While Bot’s reasoning may be admirable, Tene writes in this post for Privacy Perspectives, it is hardly true that his lofty values are served by his own opinion.
